This form may be used to report possible incidents of discrimination, including sexual misconduct, to the Office of Equal Opportunity and Title IX (OEO). This includes sex-based harassment, sexual assault, and other forms of sexual misconduct that you believe are in violation of University of Utah Policy 1-012. This form may also be used to report possible violations of the University’s youth protection policies. Not all questions on this form are required for submission, and those that are required are marked with a red asterisk (*). Please provide as much information as you can. Online reporting is preferred, but you may also call us at 801-581-8365 or email us at oeo@utah.edu.

Who can use this form?

  • Anyone wishing to communicate to the University that possible discrimination, including sexual misconduct, has occurred. For a list of behaviors that are categorized as sexual misconduct, see our definition in our policy linked here.
  • Individuals may fill out this form on their own behalf, or on behalf of another person.
  • All employees—except those who are specifically named as Confidential Employees in R1-012A, linked here—are Mandatory Reporters and must report possible incidents of discrimination, including sexual misconduct, immediately.

Will anyone named in this report be contacted by the OEO?

  • The individual who experienced discrimination (the Complainant) will be contacted through email with a list of their options for support. The email will say that the OEO was informed that they may have experienced discrimination, which includes sexual misconduct. They will not be informed about who reported to the OEO, or what was reported.
  • The OEO will not reach out to the individual reported for misbehavior/misconduct (the Respondent) without a request from the Complainant.
  • A reporter who was not impacted by the reported behavior will receive a confirmation email that we received their report. Reporters who are not impacted by the reported behavior are not guaranteed to receive updates about the case to protect the privacy of those involved.

Is this information confidential?

  • The OEO’s processes are considered private, not confidential.
  • To see what the OEO shares with those named in this report, see the question above: “Will anyone named in this report be contacted by the OEO?”
  • The OEO will share some of the information we receive in reports as needed (e.g., to address safety concerns) to support the impacted individual (the Complainant) or address the behavior of the reported individual (the Respondent).
  • The OEO works closely with the Office of Dean of Students, Human Resources, the Office for Faculty, and information may be shared with offices if there is a need.
  • Students, staff or faculty who would like to speak with someone confidentially should contact the Victim Survivor Advocacy at (801) 581-7776 or the University Counseling Center at (801) 581-6826. Does making a report open a complaint or investigation?

  • No. Making a report leads to outreach for the individual who experienced discrimination (the Complainant) detailing their options for support. The Complainant will have be informed of all options available through the OEO, which may include a formal complaint or a request for an investigation.

What does it mean to be a Complainant?

  • Complainant is the term the OEO uses to describe the person who experienced the reported behavior.

What does it mean to be a Respondent?

  • Respondent is the term the OEO uses to describe the person who are being reported for engaging in possible discrimination, including sexual misconduct.

I am filling out this form as a Mandatory Reporter. Does that change the information I need to provide?

  • Thank you for fulfilling our duty to report possible incidents of discrimination, including sexual misconduct, to the OEO.
  • As a Mandatory Reporter, you need to include all the information you have about the situation, including the information for the individual who experienced discrimination (the Complainant), and the information for the individual being reported for misbehavior/misconduct (the Respondent).
  • Do not submit your report anonymously. Mandatory Reporters must include their information in a report as part of their mandatory reporting duties.

I do not want to provide my information as a reporter. Is that allowed?

  • Reports can be sent anonymously to the OEO, unless you are reporting as part of your Mandatory Reporting duties.
  • Remaining anonymous in your report means your information will not be shared with the OEO. This may impact the OEO’s ability to follow up with further information or options for support.

I do not want to provide, or I’ve been asked not to provide the identity/identities of the individuals involved. Is that allowed?

  • You can leave the name for the individual who experienced discrimination (the Complainant) as unknown. You can also leave the names for the person being reported for misbehavior/misconduct (the Respondent) as unknown.
  • However, if you are a Mandatory Reporter, and you know this information, you cannot withhold it from the OEO. That information must be shared.
  • Leaving the Complainant or Respondent names as unknown will limit the OEO’s ability to provide options for support.
  • Without Complainant information, the OEO cannot provide resources and options to the individual who experienced discrimination.
  • Without Respondent information, the OEO cannot fully address the reported conduct.

Will I receive communication from the OEO after submitting my report?

  • Yes, unless you report anonymously.
  • If you are reporting your own experience, you will receive outreach from the OEO detailing your options for support.
  • If you are reporting on behalf of someone else, you will receive a confirmation that your report was received by the OEO but are unlikely to receive further information on the case from the OEO to protect the privacy of those involved.

What does the OEO do after I submit this report?

  • The information in this form goes directly to the OEO and is not automatically shared with other entities at the University.
  • The OEO will send outreach to the individual who experienced discrimination (the Complainant) detailing their options for support. The Complainant does not need to respond to our outreach if they are not interested in working with the OEO.

What if someone retaliates against me for submitting a report to the OEO?

  • University policy prohibits retaliation for engaging in activities protected under the University’s Nondiscrimination Policy, which includes reporting to the OEO.
  • This means that no person may intimidate, threaten coerce, or discrimination against any individual to interfere with their rights under this policy. These actions are also prohibited towards individuals working with the OEO in any capacity (e.g., as a reporter, Complainant, Respondent, witness, etc.).
  • Please contact the OEO if you believe you have experienced retaliation for having filed a report.
